An employment background check refers to the process of investigation on a potential employee. It is used to verify the applicant’s credentials, educational history, achievements, and other information.The pre employment screening will include a background check for criminal records, criminal history, warrants, previous sanctions and convictions. Background checks are also mandatory for people working in positions with security, financial and privacy concerns as well as with positions involving the elderly, disabled, and children.
Importance of background checks and employment screening
The Fair Credit Reporting Act (FCRA) regulates the use of consumer reports containing personal information. The law disallows discrimination or adverse decisions based on irrelevant factors found in the background check reports. It mandates the notification of the consumer or applicant to the contents of the report. The act also specifies proper procedures in the destruction and safekeeping of the reports and records.
Gun Background Checks
The National Instant Criminal Background Check System was mandated by the Brady Handgun Violence Prevention Act of 1993 and launched by the FBI on November 30, 1998. Gun store owners with Federal Firearms Licenses (FFLs) can now easily perform background checks by calling the FBI or other affiliated agencies and instantly determine whether a potential buyer is eligible to buy firearms or explosives.
Tenant Background Checks
Most landlords will require a potential tenant to submit to a background check. This will include a credit history background check to assess the potential tenant’s capacity to earn and pay rent, and usually the credit score and the person’s financial history will become the main basis whether or not he will be allowed to rent. The check will also include a criminal background check to determine the persons past behavior and if he poses a threat to the community.

Well, I want to clear things up and debunk some of the more common myths about background checks flying around out there. Here are some of the most frequently asked but wrongly answered queries about background checks.

Permanent records usually only matter if you are trying to get into a prestigious college. So you don’t have to worry about incidents or that arson case you had back in third grade, although you might want to make sure you have gotten rid of the urge to burn small rodents.

Employment and the FBI Background check database
“Will they run my name through the FBI’s database?”People often state it as a fact that employment background checks are ran through the FBI or NICS (National Instant Criminal Background Check System) database. This is generally not true, 80% of job positions and background checks do not use this database, the NIC system is reserved for gun purchase background checks, and for use by government and state departments. The only time a background checks is done using this system is with careers involving proximity with children, the elderly and the disabled as well as jobs that include security, financial and privacy concerned tasks, such as airport/port positions, government jobs, banks, security agencies, etc.
Previous employment background checks
“Will the company I am applying for check my previous employer as part of the background check?”The answer for this one is yes. Most of companies out there practice this method of background checking and only a hand-full of small companies don’t. Expect that they will call your previous employer, and will ask about your position, duties, and performance with them. It is mandatory for a large company’s human resource department to check and call your previous employers, in smaller companies, you future boss might actually be the one who would call your previous one.
Free Criminal Background Check Online Facts
“I heard there are sites than offer absolutely free background checks online instantly!”This background check myth is continually misleading a lot of people. When you think about it, what kind of company would pay a bunch of people to search for information in numerous databases in different states, fill out request forms, and go through the hassle and time of locating specific data and then give it to someone for free. It will usually take seven to ten years for misdemeanors, criminal records, negative credit reports (bankruptcies), and other records to “expire” or “rollover”. So financial mishaps, or that alcohol induced seven eleven robbery attempt would not show on the background check if it was more than seven to ten years ago. Report would sometimes show that you had a criminal record but without the details, when this happens, it is best that you be honest and forward about the incident. Show that you are remorseful and provide an explanation, most companies will be more than happy to consider you.
